1. Acceptance

By accessing or using the website at kristiandelgado.com (or any subdomain) or by engaging KD Health Management LLC ("we," "us," or "our"), operating as Kristian Delgado / Insurance Guru, as your insurance broker, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the website or our services.

These Terms work together with our Privacy Policy and Disclosures.

2. Services

We provide independent insurance brokerage services, including:

• Health insurance quoting (ACA marketplace, private/off-marketplace, Medicare)
• Group benefits consultation and enrollment (5-100+ employees)
• Ancillary product placement (dental, vision, life)
• Ongoing client service including renewals and claims escalation

We are licensed in all 50 states. Our services are available only to residents of states where we are licensed. See the Licensing page for the current state list.

3. Not a fiduciary

We are licensed insurance brokers, not fiduciaries in the legal sense. We do not provide legal advice, tax advice, or investment advice. For specific legal, tax, or investment guidance, consult an attorney, CPA, or registered investment advisor. See the Disclosures page for full discussion of our role.

4. Accuracy of information you provide

You agree to provide accurate, complete, and current information when requesting quotes, applying for coverage, or communicating with us. Insurance applications require truthful answers — material misrepresentations can result in denied claims or rescinded coverage.

You are responsible for the accuracy of information submitted on your behalf. If anything in your application or quote request changes (income, household composition, employment, health status), notify us promptly so we can update records.

5. Quotes & estimates

Any quotes, premium estimates, or rate comparisons we provide before formal carrier underwriting are estimates only. They are not guaranteed offers of insurance.

Final coverage and pricing are determined by the issuing carrier through their underwriting process and confirmed in your formal proposal or enrollment documents. Carriers may request additional information, decline to offer coverage, or offer modified terms.

6. Communications consent

By providing your contact information, you consent to be contacted by us regarding insurance products and your inquiry. This includes phone calls, text messages, and emails. You can opt out at any time by replying STOP, unsubscribing, or asking us to remove you.

Standard message and data rates may apply for text messages. We do not charge any fees for our communications, but your wireless carrier might.

7. Acceptable use

You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Submit false or fraudulent information
• Scrape, copy, or otherwise reproduce significant portions of the website without permission
• Use the website in a way that could damage, disable, or impair its functionality
• Reverse engineer or decompile any software or systems

8. Intellectual property

All content on the website — including text, design, graphics, logos, and the "Insurance Guru" branding — is owned by or licensed to KD Health Management LLC and protected by U.S. and international copyright and trademark laws.

The website contains links to third-party websites (state insurance department lookup tools, NIPR, carrier websites, government resources). We do not control these sites and are not responsible for their content, privacy practices, or availability.

Linking to a third-party site does not imply endorsement. Use third-party sites at your own risk and review their terms and privacy policies.

10. Disclaimers

The website and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The website will be uninterrupted, error-free, or secure
• Information on the website is complete, accurate, or current at every moment
• Any specific quote will result in approved coverage at the quoted price
• Any specific outcome will result from using our services

Insurance is governed by state and federal law and by the policy documents issued by carriers. Information on this website does not modify or supersede those documents.

11. Limitation of liability

To the fullest extent permitted by law, KD Health Management LLC, Kristian Delgado individually, and our affiliates, employees, and agents are not liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, lost data, or business interruption
• Damages arising from your reliance on website information without confirming with us or a carrier
• Damages caused by carrier underwriting decisions, claims denials, or carrier insolvency

If liability is established despite the above, our total cumulative liability is limited to the commissions actually earned from your insurance enrollment in the 12 months preceding the claim, or $500, whichever is greater.

Some jurisdictions do not allow certain limitations of liability — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless KD Health Management LLC, Kristian Delgado, and our affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your submission of false or misleading information
• Your unauthorized use of the website or our services

13. Termination

You can terminate the brokerage relationship at any time by notifying us in writing or by changing your agent of record with the relevant carrier or marketplace. Termination does not affect coverage already in force — your insurance policies remain governed by the terms in your policy documents.

We may decline to provide services or terminate the relationship if you violate these Terms, submit fraudulent information, or if continuing the relationship would create a conflict of interest or compliance issue.

14. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. For any insurance-specific disputes, the laws of your state of residence may also apply pursuant to that state's insurance code.

Any dispute arising out of these Terms that cannot be resolved through good-faith discussion will be brought in state or federal courts located in Miami-Dade County, Florida, except where consumer protection laws of your state of residence require otherwise.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via website notice or email. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.
